A Lubbock doctor faces up to a year in jail after a jury found him inappropriately touching an employee during a medical assessment last year.
A Lubbock County Court at Law #1 jury of four women and two men found 70-year-old Dr. Jeffrey Colvin guilty of class A misdemeanor indecent assault after three hours of deliberation Wednesday evening.
Judge Mark Hocker will hold a penalty hearing next month, court officials said. Probation is available to Colvin.
After a two-day trial, jurors heard evidence that Colvin’s medical examination of an employee went beyond her consent.
The woman who worked for Colvin testified. With 36 years of medical experience, Colvin hoped to extend his pain management practice to offer fat transfer operations, she told jurors. She told jurors he had been pressuring personnel, including her, to obtain those operations to promote them to patients.
The woman refused treatment but agreed to a breast augmentation examination to placate Colvin.
Colvin entered her office on Sept. 1, 2023, while most of her coworkers were out to lunch to analyze her fat reserves for breast augmentation.
She said she accepted to be evaluated in her office without a chaperone, against protocol. Working at Colvin’s practice “felt like a small family,” she told jurors. I couldn’t believe Dr. Colvin or that this would happen to me.
She said jurors that Colvin touched her breasts, abdomen, and thighs with her consent. After analyzing her inner thigh fat, Colvin asked to inspect her genitals to determine if labial augmentation might help.
She told jurors she consented to genital examination. However, she said Colvin kept stroking her genitals instead of palpating. He inquired about his touch’s comfort.
She up, walked around her desk to put it between her and Colvin, faced a wall, and dressed.
Michael King, Colvin’s attorney, contended in his closing argument that his client and the woman had an indiscretion between consenting adults.
A defense witness, a current employee, said that she had observed the woman act “unprofessionally” with Colvin and mentioned a few instances of her flirting with the doctor.
Another defense witness said the woman was disgruntled when Colvin changed her contract to lower her salary.
He told jurors Colvin ceased touching the former employee after the exam. On Nov. 18, 2023, Lubbock police apprehended Colvin. His bond was filed Dec. 6, 2023, court documents show.
The Texas Medical Board suspended Colvin’s license because “his continuation in the practice of medicine poses a continuing threat to public welfare.”
His license was suspended until March, when he promised to treat only men. Colvin is also suing the former employee for $1 million in the 99th District Court.
