A man from Cherry Creek, South Dakota, who was found guilty of two counts of Abusive Sexual Contact was sentenced today, according to an announcement made by United States Attorney Alison J. Ramsdell. Chief Judge Roberto A. Lange of the United States District Court handed down the punishment. The sentencing was carried out on the 10th of June, 2024.
Dana James Marshall, who is 38 years old, was given a sentence that included five years in federal prison, followed by five years of supervised release, and a special assessment to the Federal Crime Victims Fund in the sum of $200.
During the month of October in the year 2023, a federal grand jury decided to indict Marshall. A guilty plea was entered by him on March 11, 2024.

On April 15, 2022, Marshall went to his bedroom and welcomed his niece, who was 18 years old at the time. In spite of the fact that she accepted his invitation and disrobed at his request, she made it quite plain to Marshall that she did not want him to touch her sexually.
With that being said, Marshall grabbed her by the ribcage and proceeded to grope her private regions of her body. According to the Cheyenne River Indian Reservation, this incident took place at the Cherry Creek Community, which is located within the reservation as stated in justive.gov
Due to the fact that the Major Offenses Act, which is a federal statute, requires that certain violent offenses that are alleged to have happened in Indian land be prosecuted in federal court rather than state court, this matter was brought before the United States Attorney’s Office for prosecution.
The Cheyenne River Sioux Tribe Law Enforcement Service and the Federal Bureau of Investigation both conducted investigations into this case. This case was prosecuted by Assistant United States Attorney Carl Thunem.
Immediately after his arrest, Marshall was placed under the custody of the United States Marshals Service.
