Teen illegal immigrant who killed woman in Colorado crash receives probation, then is apprehended by ICE with family

Immigration authorities have seized an illegal immigrant teenager and his family after he was convicted of killing a Colorado lady in a high-speed crash and spared jail time.

Following a plea agreement with prosecutors, the 16-year-old from Colombia was sentenced to probation and community service for the July 2024 death of Kaitlyn Weaver, 24, in Aurora.

The boy, who has not been publicly identified due to state regulations that protect the identities of underage criminal suspects, was apprehended on May 20 with his family, who were also illegally present in the United States, according to US Immigration and Customs Enforcement (ICE).

“The minor was convicted in Colorado’s 18th Judicial District and sentenced to probation and community service,” said an ICE representative to Fox News. “As part of its ordinary operations, ICE arrests criminal aliens and those who have broken our country’s immigration laws. All foreigners who violate U.S. immigration law may be arrested, detained, and, if deemed removable by final order, removed from the United States, regardless of nationality.”

According to ICE, the teen will stay in custody pending an immigration hearing.

Weaver died while sitting at a stop light when a teen T-boned her at an intersection. Authorities stated he was in a Jeep with other kids, racing at speeds of up to 90 mph in a residential neighborhood.

Weaver remained on life support for two days before being taken off after her organs were donated.

Her father, John Weaver, told Fox News Digital that he was informed by U.S. Rep. Gabe Evans, R-Colo., that ICE would take action against the teenager.

“I appreciate ICE taking enforcement action, and I really appreciate the outpouring of support from everyone,” Weaver was quoted as saying Thursday.

The teenager was detained and first charged with vehicular homicide. According to John Weaver, the Arapahoe County District Attorney’s office informed them at the time that the case was a “no plea offer” matter.

They then offered the teenager a plea bargain if he accepted his crime.

In an interview with Fox News Digital, Weaver’s family attorney, Matthew Durkin, termed the arrangement “abhorrent,” stressing that she was killed in her prime.

According to John Weaver, the teen was in the United States illegally and without a license.

“We had a collision where the immigration system and the criminal justice system collided, and now my daughter’s dead,” according to him.

The teen has a pending asylum claim, but ICE says asylum claims do not prohibit detention.
