Dipak Phayal, 20, faces serious charges including first- and third-degree criminal sexual conduct, along with first-degree aiding and abetting criminal sexual conduct, according to the charging documents. Sujan Tamang, 19, is charged with two counts of first-degree aiding and abetting criminal sexual conduct, along with one count of fourth-degree of the same offense.

Two individuals face allegations of coercing a student into her dormitory on First Avenue South in St. Cloud during the early hours of November 1, followed by a sexual assault.

Surveillance footage reportedly captured them socializing in the dorm lobby as the woman arrived back at her dorm, before they left and returned after exchanging outfits.

The incident of alleged assault took place at a residence hall located on the 500 block of 1st Avenue in St. Cloud during the early hours of November 1. A criminal complaint reveals that the victim reported returning to her dorm room in the early hours, around 2-3 a.m., when she came across two unfamiliar males close to the bathroom.

The men forced her into her room and shut the door, with Tamang reportedly restraining the victim from behind as Phayal began to attack her, ignoring her “repeated cries for help.”

An Instagram account named “Dipak Phuyal” reached out to her to inquire about her well-being just hours following the reported incident.

Both individuals refuted any connection during their discussions with law enforcement. The complaint states that DNA samples collected during the victim’s medical examination matched both individuals.

Legal documents indicate that both individuals have departed from Minnesota, their locations remain undisclosed, and “”there is a substantial likelihood [they] will fail to respond to a summons.”
