A lady from Follansbee, West Virginia, was sentenced to two years of supervised probation for the death of her 14-month-old child, but she will not go to jail.
The Follansbee couple, Rachel Camilletti, 36, and Zachary Henderson, 24, were charged earlier this year when their toddler passed away on August 3, 2022, from consuming “enough fentanyl to kill a large horse.”
In May, Camilletti entered a guilty plea; as a condition of the plea deal, two further counts of gross neglect that created a significant danger of harm or death were withdrawn.
Media partner Herald Star reports that Camilletti was seeking a jail term of three to fifteen years in prison, along with a fine of $1,000 to $5,000, or both, from Brooke County Prosecutor Joseph Barki, who was chosen as the next judge of the First Judicial Circuit Court.
Before imposing the sentence, Judge Ronald Wilson of the current First Judicial Circuit Court heard testimony from Camilletti’s counsel as well as from a number of other witnesses attesting to her drug addiction treatment and her more than a year of sobriety.
Wilson told the Herald-Star that he and Barki are prohibited from speaking to the media about ongoing cases before any court by the state’s judicial code of conduct, in response to a question regarding the sentencing.
Wilson did confirm to the news organization that the defendant was put on a two-year probationary period and that the case would not be resolved until it is.
Herald-Star reports that Henderson plans to go to trial for the circuit court-pending accusation of child maltreatment resulting in death that was brought against him.
